Upon completion of the order, you will receive an automatic email to the email address provided by you. This email confirms the successful order registration and forwarding to us.

The buyer acknowledges that, after placing the order on the site, and after confirmation by phone or email by an employee, an electronic sale-purchase contract, respectively delivery, between the parties, concluded for the ordered product.

The products included in the orders accepted by the Seller will be delivered according to the stipulated conditions regarding payment and delivery.

The products made to order, respectively the glasses made in accordance with the client's specifications (prescription) do not benefit from the right of cancellation until the fulfillment of the term offered by our operators.

OPTICA ALBINA reserves the right to refuse total or partial acceptance of an order made by the Buyer, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other, in the following cases: the products do not exists in stock, payment is not completed, the data provided by the customer / member are incomplete or incorrect, the buyer's activity may cause damage of any kind to OPTICA ALBINA or its partners, there is one or more confirmation orders and not picked up.

Optica Albina reserves the right to cancel the order placed by the customer, within 72 hours from the notification of the customer by email and / or SMS about the availability of lifting the order from the Showroom, without attracting any subsequent obligation of any party to the other party or without either party being able to claim damages from the other.

OPTICA ALBINA will not be liable to the Buyer or any third party for removing any product from the Site, for removing or modifying any material or content from this Site.

Chapter X. Details of the sale-purchase contract

DISTANCE TRADE CONTRACT

Art. 1. OBJECT OF THE CONTRACT

Art. 4. OBLIGATIONS OF THE SELLER

4.1. Deliver the products in the original packaging of the manufacturer, sealed and without damage

Art. 5. OBLIGATIONS OF THE BUYER

5.2. It undertakes to pay the value of the contract (value of products and value of delivery) upon receipt of the products.

5.4. To the extent that the buyer is in possession of a prescription / prescription for diopters, he undertakes to ensure that it has been provided by qualified personnel. The medical prescription cannot be older than 12 months.

5.5. If the buyer orders eyeglasses, and has a prescription for glasses, and if he wants contact lenses then he will have a special recipe for contact lenses. By placing the order, the buyer confirms that it was made according to the parameters and the type of lens prescribed by the specialist.

5.6. It undertakes to provide accurately the details of the prescription (including additional notes to the prescription).

5.7. In the case of contact lenses, the customer confirms that after consulting and prescribing contact lenses he has read and will strictly follow the rules regarding the maintenance and use of contact lenses. For any questions or concerns, buyers are urged to contact before purchasing and using these medical devices.

5.8. In the case of maintenance solutions for contact lenses and artificial tears (eye drops) the buyer will read and strictly follow the instructions mentioned on the product leaflets provided by the seller. If he has not received, by mistake, the package leaflet of this type of product, the buyer will ask the seller before use.

5.9. To avoid any confusion, by placing an order through our site, the buyer guarantees that:

  • use our services voluntarily;
  • the data contained in the registration form are true and do not infringe the rights of third parties;
  • where applicable, it has been subjected to an ophthalmological test by an accredited ophthalmologist / optometrist and guarantees that the value of the lens diopters introduced during the ordering process is in accordance with the prescription prescribed by the ophthalmologist.

We advise you to always consult your ophthalmologist or optometrist before trying a new brand of lens. We would like to inform you that the use or change of contact lenses without the approval of the ophthalmologist / optometrist may pose a medical risk and the seller is not responsible for any injuries or discomfort caused by wearing contact lenses purchased from our store or received free of charge.

Art. 6. TRANSFER OF PROPERTY

Ownership of the goods / products will be transferred at the time of payment, by the buyer, to the location indicated in the order.

According to art. 18 para. (1) Emergency Ordinance no. 34/2014, excepţtake the case îin which părţthey agreed otherwise on the time of delivery̆rii,sellersupplied̆ transfer productŝnd physical possession̆ or control over products such as̆three consumer, făInquiry̆ and̂ntâunjustified delay and, in any case, within a maximum of 30 days from the conclusion of the contract.

In this respect, the goods / products will be delivered to the buyer, who proceeds to sign the receipt of the transport document, provided by the courier, or to sign the receipt, on the tax invoice, in case of deliveries made by the seller's staff.

In the case of delivery by post or courier, it is not authorized by the seller to allow the buyer to open the packages before signing the delivery, but only after signing the delivery and paying the possible value of those packages. If, after the transfer of ownership, the buyer finds differences between the order (invoice) and the contents of the package, he will notify the seller in writing, within a maximum of 3 days.

Art. 7. THE RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT

7.1. Products delivered bywww.optica-albina.roare in the original packaging, sealed. Also, some categories of products sold through the online platform are products that by their nature, after unsealing, can no longer be returned.

7.2. The buyer has the right to unilaterally terminate the distance contract in writing, within 14 working days of receiving the products, without penalties and without invoking any reason. In this situation, the Buyer is obliged not to unseal the products.

7.3. By appealing to the right of unilateral termination of the contract, the buyer will have to pay the value of returning the products.

7.4.www.optica-albina.rowill reimburse the amounts paid by the buyer for the delivery of the products, without asking him for the expenses related to the reimbursement of the amounts. Reimbursement of amounts will be made within 14 days from the date on which he is informed of the decision to unilaterally terminate the distance contract. For the avoidance of any doubt, the 14-day period runs from the date on which the product is actually returned to the seller.

Art. 8. CONTRACTUAL LIABILITY.

Article 9. GUARANTEES

Neither party will be liable for non-performance of its contractual obligations if such non-performance is due to a force majeure event. Force majeure is the unpredictable event, beyond the control of the parties and which cannot be avoided.

Art. 11. APPLICABLE LAW

This contract is subject to Romanian law. Any disputes arising betweenwww.optica-albina.roand its clients will be settled amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.

Chapter XI. Delivery and payment

The delivery of the products has a national expansion area and, thus, will be done anywhere in Romania by express courier as soon as possible by telephone confirmation or pick-up from Optica Albina showrooms free of charge, according to the operating program displayed on the site in the Contact section .

Payment for products can be made by cash on delivery, online by bank card through the payment processor Mobilpay,payment by POS in the showroom.

You can pay in cash, exclusively in lei, both for the purchases on Optica Albina.ro, and for those in our showrooms, as follows: • by cash on delivery, to the courier, upon delivery of the products ordered on Optica Albina.ro; cash register, in the showroom, for orders placed directly in the store through the staff at the houses;

Bank card payment:

You can pay with any bank card issued under the logos Visa (Visa and Visa Electron) or Mastercard (Mastercard and Maestro), both on Optica Albina.ro and in all our showrooms.

Online card payment in 0% interest installments:

If you have a credit card, you can buy in interest-free installments from Optica Albina.ro or from our showrooms. The credit cards accepted online are Card Avantaj, Star BT, Garanti BonusCard, Alpha Bank, BRD Finance and in our showrooms, only Avantaj card.

The cost of delivering an order is worth RON 7.49.

Refusal and / or non-withdrawal within 60 calendar days from the completion of the order of personalized glasses with the specifications in your recipe, leads to the cancellation of the order and the loss of the advance paid.

The prices of our products can be changed at any time and without notifications, this change will not have an impact on previously placed orders.

The prices displayed on the site for the products are in RON and include VAT. The total price of an ordered product includes its price and courier fees (including VAT), if applicable. The final price changes if the delivery fees increase or if it is a locality that is not in the coverage area of ​​the courier network.

We reserve the right to modify or discontinue certain or more Services (or any part or content of the online store) at any time without prior notice.

We will not be liable to you or any third party for any changes, suspensions or terminations of certain or more Services.

Chapter XIII. Return policy

According to the Emergency Ordinance No. 34/2014 on consumer rights in distance contracts: The consumer has the right to withdraw from the distance contract, without having to justify the decision to withdraw and without incurring other costs than those provided in Article 13 para. 3) and art. 14 of GEO No. 34/2014, within 30 calendar days starting from the day when it enters the physical possession of the product.

  • Sealed products (packaging / box of contact lenses, blisters, vials) that cannot be returned for reasons of health protection or hygiene and that have been unsealed by the consumer are exempt from the right of return, according to Emergency Ordinance no. . 34/2014 on consumer rights in contracts concluded with professionals, Article 16, point e).
  • The returned product must be in the same condition in which it was delivered - without signs of wear or other defects, in the original packaging with all accessories, with the labels intact and the accompanying documents. In the case of products in the consumables category (contact lenses, care solutions ... etc.), their packaging must be sealed, intact and unopened - in full compliance with hygiene rules - otherwise the return request will be rejected.

  • Products made according to the specifications presented by the consumer or clearly personalized (eyeglasses made according to prescription), according to the Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, Article 16, point c. They are exempted from the right of withdrawal.).

All components of the product must NOT show signs of damage (scratches, bumps), wear or consumption and will be checked to determine their integrity. Products with completely or partially deleted series will not be accepted. Otherwise, the Seller reserves the right to refuse the return or to charge a fee for bringing the products to their original condition.

Our operators will support you in choosing the return method and will provide you with the necessary details regarding the shipping address of the products, packaging or contacting the courier company.

For the return of purchased products that meet the conditions of the law presented above, please send an e-mail to support @ Optica Albina.ro to fill in the necessary data.

You can also fill in and send to the email address support @ Optica Albina.rothe standard withdrawal form provided byOUG 34/2014.

Subsequently, we will send the courier to pick up the package from you. It will be sent to TENSA ART DESIGN SRL, Bd. Iuliu Maniu, no. 7, corp A, sc. 3, sector 6, Bucharest. The return costs will be borne by Optica Albina only if you have previously announced the return of the products to the e-mail address mentioned above.

The returned product must be in the same condition in which it was delivered (in the original packaging with all accessories, with the labels intact and the documents that accompanied it). We will make this refund using the same payment method as the one used for the initial transaction, unless you have expressly agreed to another refund method; In any case, you will not be charged any fees as a result of such a refund. We can postpone the refund until the date we receive the products back, in order to perform the quantitative and qualitative reception of the returned products.

Any product you return must not be used or damaged. You are only responsible for diminishing the value of the products resulting from handling, other than those necessary to determine the nature, qualities and functioning of the products. If the product is returned in a condition that can no longer be resold as new, we reserve the right to charge a fee for returning the product to its original condition (if possible) or to cover the price difference resulting from the sale of the product as second-hand, or at the customer's option, we will resend the product to him, at his expense.

The refund period of the value of the returned product will be made in maximum 14 calendar days from when the returned product arrived at the address specified above.

You will not pay for the return of the products if you have received a product with a manufacturing defect or a wrong product.

We reserve the right not to honor orders made by individuals or legal entities that have made 3 consecutive returns in the last 12 months.

Money back 30 days

At www.optica-albina.ro customer satisfaction is a priority. If you have placed the wrong order or are not fully satisfied with the products purchased, then you have the right to return the products within 30 calendar days of receiving them, in accordance with the Return Policy (see previous chapter).

Please note that glasses made to order on a prescription basis or to the customer's specifications cannot be returned. The guarantee of the products is offered based on the electronic invoice issued.

The granting of the guarantee refers exclusively to manufacturing defects or hidden defects notified during the warranty period and only under the conditions of their proper wearing, storage and maintenance. The ascertainment of the defects, of their nature and causes is made at the seller's headquarters and / or, as the case may be, at the manufacturer's headquarters.
